These Terms of Service (the “Terms”), together with any policies referenced herein (including our Privacy Policy and Refund & Return Policy), describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Company Information:
These Terms constitute a legally binding agreement between you and Foster's Goods, which is the trade name of 16892426 Canada Inc., an Ontario-registered corporation.

SECTION 1 – ACCESS AND ACCOUNT

You represent and warrant that you are at least the age of majority in your province, state, or region of residence, or that you have the consent of a parent or guardian to allow any minor dependents to use the Services on devices you own or manage.

To use the Services (including making a purchase), you may be required to provide information such as your email, billing, payment, and shipping details. You warrant that all information you provide is accurate, current, and complete, and that you have all necessary rights to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not transfer or sell your account.

SECTION 2 – OUR PRODUCTS

We work diligently to describe and display our products as accurately as possible; however, colors and appearance may vary depending on your device settings. We do not warrant that any product will meet your expectations or exactly match on-screen depictions.

Product descriptions, pricing, and availability are subject to change at any time without notice. We reserve the right to discontinue products or limit quantities to any person, household, region, or jurisdiction at our sole discretion.

SECTION 3 – ORDERS, PAYMENT, AND BILLING

Your submission of an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason. An order is not accepted by us, and a contract does not exist, until we confirm your order and process your payment. Please review your order carefully before submitting; cancellations may not be possible after an order is accepted. If we do not accept your order or must cancel or modify it, we will attempt to notify you using the contact details you provided at checkout.

All purchases are subject to our Refund & Return Policy. You represent and warrant that your purchases are for personal or household use and not for resale or export.

Prices, promotions, and discounts are subject to change without notice. The price charged will be the price in effect at the time of your order and as shown in your order confirmation email. Unless expressly stated otherwise, all prices are exclusive of applicable taxes, shipping, handling, customs, and import charges.

You agree to provide current, complete, and accurate payment and account information. You agree to promptly update your account and payment information, including providing a new expiration date for your payment method. You warrant that (i) your payment information is true and authorized; (ii) you are authorized to use the payment method; (iii) charges will be honored by your financial institution; and (iv) you will pay all amounts incurred, including taxes, shipping, and applicable fees.

SECTION 4 – SHIPPING AND DELIVERY

Any delivery timeframes provided are estimates only and are not guaranteed. We are not liable for any delays caused by carriers, customs, weather, or other events beyond our reasonable control. Title and risk of loss for all products pass to you upon our transfer of the products to the carrier. For more details, please refer to our Shipping Policy.

SECTION 5 – HEALTH & SAFETY DISCLAIMER (SUPPLEMENTS)

The information provided on the Site is for general informational purposes only and is not a substitute for professional medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease. To the fullest extent permitted by applicable law, the Services and all products are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties; therefore, some of the above exclusions may not apply to you.

To the fullest extent permitted by law, in no event will Foster’s Goods, our officers, employees, affiliates, agents, contractors, service providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, replacement costs, or similar damages, arising from or related to your use of the Services or products, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or related to these Terms or the Services will not exceed the amount you paid for the product(s) giving rise to the claim.
